Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Vetlink Jobs website, including any associated services, employer profiles, job advertisements, candidate profiles and other features made available through the Platform.
By creating an account, posting a job advertisement, applying for a position, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
These Terms form a legally binding agreement between you and Vetlink Employment Service Pty Ltd (ABN 82 686 022 323), trading as Vetlink Jobs ("Vetlink Jobs", "Vetlink", "we", "us" or "our").
1. About Vetlink Jobs
Vetlink Jobs is an online employment marketplace that connects employers with veterinary nurses, veterinary receptionists, animal attendants, practice managers and other veterinary support staff seeking employment opportunities.
Vetlink Jobs provides an online advertising platform only. Unless expressly agreed in writing, Vetlink Jobs is not acting as an employment agency or recruitment consultant in relation to vacancies advertised through the Platform.
Vetlink Jobs is not:
- the employer of any job seeker;
- an employment agency for positions advertised through the Platform;
- a party to any employment contract entered into between an employer and a job seeker; or
- responsible for negotiating, supervising or administering any employment relationship.
Employers and job seekers are solely responsible for their dealings with one another.
2. Definitions
In these Terms:
Account means a registered user account on the Platform.
Applicant means a Job Seeker who applies for a position through the Platform.
Application means any application, résumé, curriculum vitae, cover letter, supporting documents or other information submitted in connection with a job advertisement.
Employer means any individual, veterinary practice, business or organisation that creates an account or advertises employment opportunities through the Platform.
Employer Content means all information, text, logos, images, videos, job advertisements and other material submitted by an Employer.
Job Seeker means any individual using the Platform to search for or apply for employment opportunities.
Platform means the Vetlink Jobs website and any associated services, software and functionality provided by Vetlink Jobs.
Subscription means any recurring paid advertising plan offered by Vetlink Jobs.
User means any person who accesses or uses the Platform, including Employers and Job Seekers.
User Content means any information or material uploaded, submitted or published by a User.
3. Eligibility
To use the Platform, you must:
- comply with these Terms and all applicable laws;
- provide accurate, current and complete information; and
- have the legal capacity to use the Platform for your intended purpose.
If you create an Employer Account, you represent and warrant that:
- you have the legal capacity to enter into these Terms and any applicable subscription or payment arrangements; and
- if you are acting on behalf of a veterinary practice, company or other organisation, you are authorised to act on its behalf and to bind that organisation to these Terms.
If you create a Job Seeker Account, you represent and warrant that you are legally entitled to seek employment in the relevant jurisdiction.
Vetlink Jobs may refuse, suspend or terminate access to the Platform where we reasonably believe these requirements have not been met.
4. Accounts
Some features of the Platform require you to create an Account.
When creating an Account, you agree to:
- provide accurate and complete information;
- keep your information up to date;
- maintain the confidentiality of your login credentials;
- notify us promptly of any unauthorised use of your Account; and
- accept responsibility for all activity conducted through your Account.
You must not:
- create an Account using false or misleading information;
- impersonate another person or organisation;
- create multiple Accounts for the purpose of avoiding fees or restrictions;
- transfer your Account to another person without our prior written consent; or
- allow another person to use your Account in a manner that breaches these Terms.
You are responsible for ensuring that your Account information remains accurate and up to date.
We reserve the right to suspend, restrict or close any Account that breaches these Terms or is used in a manner that may harm the Platform, its users or the integrity of our services.
5. Employer Responsibilities
Employers are solely responsible for the content and management of all job advertisements they publish.
By posting a job advertisement, an Employer warrants that:
- the position is genuine and currently available;
- they are authorised to recruit for the advertised position;
- all information contained in the advertisement is accurate, complete and not misleading;
- the advertisement complies with all applicable laws;
- the position does not unlawfully discriminate against any person;
- salary, employment conditions and other material information are represented honestly; and
- the advertisement does not infringe the intellectual property or other rights of any third party.
Employers are responsible for ensuring that any employment offered complies with all applicable employment, workplace, taxation and immigration laws.
Employers remain solely responsible for all recruitment decisions, including interviewing, reference checking, verifying qualifications, assessing suitability, making employment offers and determining the terms and conditions of employment.
Vetlink Jobs does not endorse any Employer or any advertised position.
6. Veterinary Registration, Qualifications and Employment Requirements
Employers are solely responsible for ensuring that any person they employ satisfies all legal and professional requirements applicable to the position.
Without limitation, Employers are responsible for verifying, where relevant:
- professional registrations;
- licences;
- permits;
- visa and work rights;
- qualifications;
- certifications;
- professional memberships;
- identity;
- references; and
- any other requirement necessary for the role.
Where a position requires registration with a Veterinary Surgeons Board or equivalent regulatory authority, it is the Employer's responsibility to confirm that the successful applicant holds the required registration before employment commences.
Information published on the Platform should not be relied upon as verification of any person's qualifications or registration status.
7. Insurance
Employers are solely responsible for ensuring that all employees engaged through the Platform are covered by any insurance required by law or otherwise appropriate to the employment relationship.
This may include, without limitation:
- workers' compensation insurance;
- professional indemnity insurance;
- public liability insurance; and
- any other insurance required by applicable legislation or the nature of the position.
Vetlink Jobs accepts no responsibility for arranging, verifying or maintaining any insurance cover relating to employment obtained through the Platform.
8. Job Seeker Responsibilities
Job Seekers are responsible for ensuring that all information they submit through the Platform is accurate, current and truthful.
By submitting an Application or creating a Job Seeker profile, you warrant that:
- all qualifications, registrations, licences and certifications you claim to hold are genuine;
- your employment history is accurate;
- any referees you nominate have agreed to be contacted (where required);
- you are legally entitled to work in the country in which you are seeking employment, or you have accurately disclosed any visa requirements;
- any documents you upload belong to you or you have permission to use them; and
- you will promptly update your information if it becomes inaccurate.
You must not knowingly submit false, misleading or deceptive information.
Employers are responsible for independently verifying the information provided by applicants before offering employment.
9. Job Advertisements
Employers must ensure that all job advertisements:
- accurately describe the position being offered;
- relate to a genuine employment opportunity;
- comply with applicable laws;
- are not false, misleading or deceptive;
- do not contain offensive, defamatory or unlawful material;
- do not infringe the intellectual property or other rights of any third party; and
- are relevant to the veterinary profession or veterinary support industry.
Advertisements must not:
- promote illegal activities;
- advertise multi-level marketing, commission-only schemes or unrelated business opportunities;
- contain malware or malicious code;
- contain discriminatory language prohibited by law;
- intentionally misrepresent salary, benefits or employment conditions; or
- promote products or services unrelated to recruitment.
Vetlink Jobs reserves the right to edit formatting, correct obvious spelling or grammatical errors, or request clarification where necessary to improve the quality or consistency of advertisements. We may also refuse, suspend or remove any advertisement that we reasonably believe breaches these Terms or may adversely affect the integrity of the Platform.
Publication of a job advertisement does not constitute Vetlink Jobs' endorsement of the Employer or the advertised position.
10. Applications
Applications submitted through the Platform are sent directly to the Employer unless otherwise specified in the job advertisement.
Vetlink Jobs is not responsible for:
- reviewing applications;
- forwarding applications outside the Platform;
- acknowledging receipt of applications;
- arranging interviews;
- communicating recruitment decisions; or
- responding to unsuccessful applicants.
Employers are solely responsible for managing their recruitment process.
Job Seekers acknowledge that submission of an Application does not guarantee an interview or offer of employment.
Employers acknowledge that publishing a job advertisement does not guarantee they will receive applications or successfully fill a vacancy.
11. Employer Profiles
Employers may create a public profile to provide information about their organisation.
Employers are responsible for ensuring that all profile information is accurate and kept up to date.
Employer profiles must not contain:
- misleading information;
- false claims;
- defamatory content;
- offensive material; or
- content that infringes another person's intellectual property rights.
Vetlink Jobs may edit, suspend or remove Employer profiles that breach these Terms or no longer accurately represent the Employer.
12. Featured Listings and Promotional Services
Vetlink Jobs may offer premium advertising products, including Featured Listings and other promotional services.
Unless otherwise stated:
- promotional placement does not guarantee applications or successful recruitment;
- promotional services do not constitute an endorsement of the Employer or advertised position;
- featured placement may be affected by the number of other featured advertisements appearing on the Platform; and
- Vetlink Jobs may modify the presentation of featured advertisements from time to time as the Platform evolves.
13. Subscription Services
Certain advertising products are offered on a recurring subscription basis.
By purchasing a Subscription, the Employer authorises Vetlink Jobs to charge the applicable subscription fee using the nominated payment method at each renewal date until the Subscription is cancelled.
Subscription pricing, billing frequency and included features are described on the Platform at the time of purchase.
Employers are responsible for ensuring that their payment details remain current.
If a recurring payment cannot be processed, Vetlink Jobs may suspend or remove the relevant advertisement until payment has been successfully received.
14. One-off Job Listings
Where an Employer purchases a one-off job advertisement, the advertisement will remain published for the period specified at the time of purchase unless removed earlier under these Terms.
The advertising period commences when the advertisement is published, not when it is created.
15. Cancellations
Employers may cancel a Subscription at any time through their account or by contacting Vetlink Jobs.
Cancellation prevents future subscription renewals but does not entitle the Employer to a refund for any current billing period already paid.
Where a Subscription is cancelled, the advertisement will generally remain active until the end of the current paid subscription period unless otherwise stated.
16. Refunds
Unless required by Australian Consumer Law, advertising fees and subscription payments are non-refundable.
Vetlink Jobs does not provide refunds because:
- an Employer receives fewer applications than expected;
- a vacancy is filled earlier than anticipated;
- an Employer decides to withdraw a vacancy;
- an Employer changes its recruitment plans; or
- a Job Seeker withdraws an application or accepts another position.
Nothing in these Terms excludes any rights or remedies that cannot lawfully be excluded under Australian Consumer Law.
17. User Content
Users retain ownership of the content they submit to the Platform.
By submitting User Content, you grant Vetlink Jobs a non-exclusive, worldwide, royalty-free licence to:
- host;
- store;
- reproduce;
- display;
- publish; and
- distribute
that content solely for the purpose of operating, promoting and improving the Platform.
You warrant that you have the necessary rights to submit the content and that its publication does not infringe the rights of any third party.
You remain responsible for all User Content that you submit.
18. Privacy
Your use of the Platform is also governed by our Privacy Policy.
Employers who receive Applications through the Platform must use applicants' personal information solely for genuine recruitment purposes.
Employers must not:
- sell applicant information;
- disclose applicant information to unrelated third parties except as reasonably necessary for recruitment;
- use applicant information for marketing purposes without consent; or
- retain applicant information longer than reasonably necessary or permitted by law.
Users agree to comply with all applicable privacy legislation when collecting, using or storing personal information obtained through the Platform.
19. Acceptable Use
You agree to use the Platform responsibly and only for its intended purpose as an employment marketplace for the veterinary profession.
You must not use the Platform in any manner that:
- breaches any applicable law or regulation;
- infringes another person's legal rights;
- interferes with the operation or security of the Platform;
- disrupts the experience of other users; or
- is likely to damage the reputation of Vetlink Jobs.
Users must not attempt to bypass any security measures or access any part of the Platform for which they are not authorised.
20. Prohibited Conduct
Without limiting Section 19, Users must not:
- create a false identity or impersonate another person or organisation;
- post false, misleading or deceptive information;
- advertise positions that do not genuinely exist;
- submit fraudulent job applications;
- upload viruses, malware or other malicious software;
- use automated software, bots, spiders, crawlers or scraping tools to access or collect information from the Platform without our prior written consent;
- interfere with or disrupt the operation of the Platform;
- harvest or collect personal information about other users;
- use the Platform for unsolicited marketing or spam;
- copy, reproduce or republish substantial parts of the Platform without permission;
- attempt to reverse engineer or circumvent any security features of the Platform; or
- encourage or assist another person to engage in any prohibited conduct.
We may investigate suspected breaches of these Terms and cooperate with law enforcement authorities where required by law.
21. Intellectual Property
Unless otherwise stated, all intellectual property rights in the Platform, including its design, layout, branding, logos, graphics, software and content created by Vetlink Jobs, remain the property of Vetlink Employment Service Pty Ltd or its licensors.
Nothing in these Terms transfers ownership of any intellectual property to a User.
Users must not reproduce, distribute, modify or commercially exploit any part of the Platform without our prior written consent.
This clause does not affect ownership of User Content submitted by Employers or Job Seekers.
22. Suspension and Termination
Vetlink Jobs may suspend, restrict or terminate a User's Account immediately if we reasonably believe that the User has:
- breached these Terms;
- provided false or misleading information;
- engaged in fraudulent or unlawful conduct;
- failed to pay applicable fees;
- misused the Platform; or
- acted in a manner likely to damage the reputation or operation of Vetlink Jobs.
Where reasonably practicable, we will notify the User of the reason for the suspension or termination.
Termination of an Account does not affect any rights or obligations that accrued before termination.
23. Availability of the Platform
While we aim to provide reliable access to the Platform, we do not guarantee that the Platform will always be available, uninterrupted, secure or free from errors.
From time to time, we may:
- perform maintenance;
- install updates;
- modify features;
- improve functionality; or
- temporarily suspend access to all or part of the Platform.
To the maximum extent permitted by law, Vetlink Jobs is not liable for any loss arising from temporary interruptions, delays or technical issues affecting the Platform.
24. No Guarantees
Vetlink Jobs provides an online advertising platform only.
Accordingly, Vetlink Jobs does not warrant or guarantee:
- that Employers will receive any applications;
- that Job Seekers will obtain employment;
- that any advertised position will remain available;
- the suitability, qualifications, competence or conduct of any Employer or Job Seeker;
- the accuracy or completeness of information supplied by Users; or
- the outcome of any recruitment process.
Employers are responsible for making their own enquiries before employing an applicant.
Job Seekers are responsible for making their own enquiries before accepting employment.
25. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.
Subject to the preceding paragraph, and to the maximum extent permitted by law, Vetlink Jobs excludes all liability for any indirect, incidental, consequential, special or exemplary loss or damage arising out of or in connection with the use of the Platform.
Without limitation, Vetlink Jobs is not liable for:
- loss of business;
- loss of revenue;
- loss of profits;
- loss of opportunity;
- reputational damage;
- loss of data; or
- business interruption,
whether arising in contract, tort (including negligence), statute or otherwise.
Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law.
Where permitted by law, Vetlink Jobs' total liability in relation to any claim arising from a paid advertising service is limited to the amount paid by the Employer for that particular service during the 12 months immediately preceding the claim.
26. Indemnity
You agree to indemnify and hold harmless Vetlink Employment Service Pty Ltd, its directors, employees, contractors and agents against any claim, liability, loss, damage, cost or expense (including reasonable legal costs) arising from:
- your breach of these Terms;
- your misuse of the Platform;
- your User Content;
- your breach of any law; or
- your infringement of another person's rights.
This indemnity continues after your use of the Platform ends.
27. Changes to the Platform
We may introduce new features, remove features, modify services or discontinue parts of the Platform at any time.
We may also change advertising products, subscription plans and pricing from time to time.
Changes to pricing will not affect any current prepaid advertising period but may apply to future purchases or subscription renewals.
28. Changes to these Terms
We may amend these Terms from time to time.
The latest version will always be published on the Platform together with the effective date.
Your continued use of the Platform after revised Terms take effect constitutes acceptance of those revised Terms.
29. Governing Law
These Terms are governed by the laws of Western Australia.
The parties submit to the non-exclusive jurisdiction of the courts of Western Australia and any courts entitled to hear appeals from those courts.
30. Severability
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in full force and effect.
31. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms expressly incorporated by reference, constitute the entire agreement between Vetlink Jobs and the User regarding use of the Platform.
They replace any prior agreements, understandings or representations relating to the Platform.
